  • Other companies in the ONE Group acting as joint controllers or processors and who are based in Japan and Singapore and who provide IT and system administration services and undertake leadership reporting.
  • Service providers;
  • Professional advisers;
  • Regulators and governmental authorities;
  • Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. Where we disclose your personal data to third party data processors, we will not allow third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions. Where we disclose your personal data to third parties that are joint data controllers, such third parties will be under direct obligations to you.

6. International Transfers

We share your personal data within the ONE Group. This will involve transferring your data outside your country/area some of which are outside the UK or European Economic Area (“EEA”).

Some of our external third parties are based outside the UK or so their processing of your personal data will involve a transfer of data outside the UK or EEA.

Whenever we transfer your personal data out of the UK or EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • Transfer to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission.
  • Transfer to service providers under specific contracts approved by the European Commission which give personal data the same protection it has in Europe.

    1. DADOS QUE SÃO PROTEGIDOS PELA LGPD

    A ONE é uma empresa que presta serviços de transporte de contêineres e operações portuárias internacionais, auxiliando nossos clientes a realizarem operações de exportação e importação de diversos tipos de produtos, inclusive por meio de e-commerce. Nesse sentido, os dados pessoais utilizados possuem finalidade específica e se restringem ao escopo da especialidade da ONE.

    Assim e objetivamente, a ONE utiliza as informações e os seus dados pessoais coletados para cumprir as seguintes finalidades:

    • Viabilizar a prestação de serviços de transporte de contêineres e operações portuárias, inclusive com atendimento de solicitações de autoridades competentes e cumprimento de obrigações legais e/ou regulatórias;
    • Celebrar contratos com fornecedores, clientes, parceiros e outros;
    • Atender chamados ou pedidos de contatos, sempre que solicitado;
    • Operar o serviço contratado, mantendo sua qualidade e promovendo estatísticas gerais quanto à sua utilização;
    • Promover atividades de suporte e acompanhamento durante a prestação do serviço, incluído o rastreamento da carga;

    • Perguntar a sua opinião acerca do atual serviço contratado ou sobre potenciais serviços que possam ser interessantes para você;

    3. DADOS PESSOAIS COLETADOS PELA ONE

    Embora as atividades da ONE sejam majoritariamente voltadas a pessoas jurídicas, o acesso a todas as funcionalidades das plataformas ONE (site, Login do Provedor de Serviços, ONE e-Commerce Login, chatbot), a operacionalização dos serviços, bem como a sua prestação a clientes pessoa física, dependem da coleta e compartilhamento de dados pessoais.

    Esse conjunto de dados pode conter os seguintes tipos de dados pessoais:

    • Dados de identificação e contato, como: nome completo, RG, CPF, e-mail, endereços de origem e destino, telefone de contato, cópias de documentos pessoais, instrumentos de mandato;
    • Dados exigidos para documentação portuária e alfandegária, como: Declaração de Liberação de Exportação, Declaração de Liberação de Importação, dados de tripulação, dentre outros;
    • Dados de navegação no site, como: endereço de IP, páginas visitadas no nosso site, dados de geolocalização e de identificação dos aparelhos;
    • Dados de pagamento, quando houver a contratação dos serviços da ONE por pessoas físicas.

    No momento da contratação, preenchimento dos formulários e/ou termos da ONE, documentos portuários, alfandegários e relativos à carga, bem como cadastramento nos sistemas da empresa, é importante que você, ou a pessoa autorizada por você, preencha os seus dados pessoais e insira apenas as informações verdadeiras e atualizadas, uma vez que a ONE não se responsabiliza pela sua verificação. A responsabilidade, em qualquer caso, civil e/ou criminal, é sua quanto à veracidade, exatidão e autenticidade das informações incluídas em nosso banco de dados.

    4. DO TRATAMENTO E COMPARTILHAMENTO DE DADOS PESSOAIS

    A ONE será a controladora dos seus dados pessoais, quando os seus serviços forem contratados, na relação com os contatos em seus clientes, dados constantes de documentação encaminhada por seus clientes no âmbito da prestação de serviços, bem como quando esses dados forem inseridos através do site da ONE no Brasil (https://www.one-line.com/pt-br/local-information/br) ou captados por um de seus sistemas. Nesses casos, é nossa responsabilidade eleger adequadamente as bases legais condizentes com as finalidades previstas na presente política, bem como atender de forma direta às suas solicitações quanto aos direitos previstos na LGPD.

    A ONE pode compartilhar seus dados pessoais com outras empresas que contribuam para melhorar ou facilitar as operações por meio do site ou sistema, como por exemplo: ferramentas de gerenciamento de bancos de dados, gerenciamento de e-mails, recrutamento e seleção, fluxos internos e de atendimento aos usuários, dentre outros.     Por se tratar de um grupo multinacional, existem situações de compartilhamento de dados entre empresas da ONE em diferentes países, notadamente pela utilização de sistemas e bancos de dados unificados do grupo. Nessas situações, são adotados regras e códigos de conduta aplicáveis internacionalmente a todas as empresas do grupo, bem como são utilizados sistemas seguros e homologados, a fim de garantir a proteção dos seus dados pessoais não apenas no Brasil, mas também em nível internacional.

    De forma semelhante, nos casos em que haja a necessidade de transferência internacional de dados pessoais para outros países para empresas externas ao grupo da ONE, a empresa se compromete a contratar apenas fornecedores que adotem medidas de segurança e boas práticas compatíveis com o nível de proteção estabelecido pela legislação brasileira, conforme regulamentação pela Autoridade Nacional de Proteção de Dados - ANPD. Na falta de regulamentação específica, a ONE se compromete a trabalhar somente com empresas aderentes às demais normas de proteção de dados, como a GDPR europeia ou CCPA americana; empresas cujos contratos contenham cláusulas específicas para as transferências com a ONE; bem como a restringir a transferência apenas ao estritamente necessário para cumprimento das obrigações assumidas com você.

    5. PROTEÇÃO DO NOSSO SISTEMA E DOS SEUS DADOS PESSOAIS

    Para proteger os dados pessoais coletados e garantir a segurança dos nossos sistemas, A ONE utiliza tecnologias e procedimentos adequados de acordo com o nível de risco e o serviço fornecido, possuindo uma equipe responsável por gerenciá-los em conformidade com as previsões legais, requisitos regulatórios, mudanças de tecnologia, dentre outros fatores relevantes que possam influenciar a proteção de dados.

    Em razão da própria natureza da Internet, existe o risco de que terceiros mal-intencionados acessem indevidamente as informações armazenadas nos nossos sistemas. Caso isso ocorra, nós nos responsabilizaremos nos limites previstos na legislação vigente aplicável.

    É proibido o uso de qualquer dispositivo, software ou outro recurso que venha a interferir nas atividades e operações da ONE, tanto pelo site quanto por outros sistemas ou bancos de dados. Caso seja identificada qualquer intromissão, tentativa, ou atividade que viole ou contrarie as leis de direito de propriedade intelectual e/ou as disposições estipuladas nessa Política, termos de uso e/ou leis vigentes aplicáveis, aí incluída a LGPD, o responsável estará sujeito às sanções aplicáveis, tais quais estejam previstas em lei ou previstas neste documento.     A ONE se compromete a preservar a manutenção dos direitos previstos na LGPD, a saber:

    • Direito de confirmação: você poderá confirmar se a ONE realiza o tratamento de algum dado pessoal seu.
    • Direito de acesso: você poderá solicitar detalhes de seus dados, bem como obter cópias de referidas informações;
    • Direito a correção: você poderá solicitar a correção de eventuais dados pessoais que estejam incompletos, inexatos ou desatualizados;

You are not necessarily required to provide us with your personal information. Notwithstanding that if you decline to provide the personal information which is necessary for our core features, we may be unable to provide you with relevant services regarding online booking, or respond to or solve any problems with which you are confronted. For other personal information, you may decide whether or not you permit us to collect. If you decline to do so, it may cause relevant customized functions to be unavailable, but will not compromise your use of our core features.

    1. How We Collect and Use Your Personal Information

    a. Information collected from direct interactions.

    • To provide you with the rate search functions
      In addition to conducting rate search on our website, you may also choose to browse relevant information by registering in our mobile application. If you choose to do rate search on our mobile application, we may collect your contact name, company name, city, phone number, email address and password, in order to satisfy the real-name registration requirement and to identify which company you are working in. However, the services and features enjoyed by mobile application users is quite limited, therefore, it is suggested to register in our website as a user of e-Commerce, for the sake of placing orders, submitting shipping instructions and enjoying other diverse functions. At current stage, you can register as an e-Commerce user only via our website, rather than the mobile application; but you can log in your e-Commerce account via both our website and mobile application.
    • To create and maintain your account in e-Commerce
      To provide you with e-Commerce account registration functionality, we may collect certain personal information, including user ID, password, first name & last name, phone number, to register you for an account; your email address is also necessary for us to send you alerts and notifications; besides, we may also collect certain company information, including the company name, country/district, city, address and company type, in order to verify your identity, validate legitimacy of the company you are working for, and perform due diligence check on any legal sanction has been issued to your company. This information is necessary for us to create and activate your account and complete our KYC process. If you decline to provide the above information, neither could we create or activate your account, nor furtherly provide you with the services contained in our Platforms.
      We also provide you with service to complete your profile, you can choose whether to provide us with your fax number, company’s zip code, for us to serve you with more tailored services. You may choose whether to fill in the above information when registering or completing your profile. We will not compel you to provide such information. Declining to provide the above information will not comprise the basic services contained in our Platforms.
    • To provide you with the online booking services and shipping instructions submission services
      After you registered as an e-Commerce user, you can proceed with online booking services, upon acceptance of the offered rates. You are required to provide the customer information, i.e., customer details of the shipper, consignee, notify party, freight forwarder. But all the mandatory information are concerned with company, not related to personal information of any individual. If you decline to provide such information, neither could you book online, nor submit shipping instructions. The shipping instructions submission is currently not yet included in the beta launching of our Platforms, however this will be available later.
      Additionally, you may also provide email address or phone number relating to an individual as contact information of a customer. Please be noted that if you are providing personal information of other individuals, please make sure that the other individuals are aware of the purpose for collecting his/her personal information and all other relevant arrangement described herein, and that he/she has consented to such disclosure and information processing.
    • To provide the live chat services
      In order to enable you to send inquiries to local offices in ONE either to local Sales or local CSVC, you may use the live chat feature powered by LiveChat Software S.A.. You are required to provide us with the name and email address. Besides, you may also provide us with your country information for us to redirect to a local specialist. If you decline to provide this information, we will not be able to provide the live chat services to you.

    b. Information collected via automated technologies or interactions

    • To ensure the normal operation of our Platforms and your account security
      In order to ensure the normal operation of our Platform and your account security (including troubleshooting, testing, system maintenance, support, reporting and hosting of data), and to optimize user experience, we may collect certain technical data, including internet protocol (IP) address, your user ID and password , browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access our services.
    • To provide you with personalized service
      In order to provide you with personalized service, such as to display and push to you information more suitable for you, we may collect your browsing actions and patterns for user profiling and behavioral analysis, including how you use our services, your preferences in receiving news or newsletters from us, reports and emails related to your shipments. You have the right to withdraw consent to marketing at any time by contacting our data privacy team using the details set out at the bottom of the Personal Information Protection Policy. After you turn it off, we will no longer use your information to personalize the marketing information you view.
    • To detect Platforms’ performance and optimize your experience
      In order to detect Platforms’ performance and optimize our services, we also collect, use and share aggregated data such as statistical or demographic data. Aggregated data may be derived from your personal information but is not considered as personal data in law as this data does not directly or indirectly reveal your identity (for example, we may aggregate your usage data to calculate the percentage of users accessing a specific website feature or our mobile application). If we combine or connect aggregated data with other data so that it can directly or indirectly identify you, we treat it as personal data, which will be used in strict accordance with this Personal Information Protection Policy.

    2. How We Use Your Personal Information

    When we need to fulfill our obligations to you under the Terms & Conditions and/or the Service Contract, or legal obligations bound to us, or we consider it necessary to protect the legitimate interests of us or third parties upon evaluation, we will process your personal data for the purposes described herein subject to your consent. We may share some of your personal information with our partners to provide services and to improve user experience. We will only share personal information that is necessary.
    • Professional advisers. We may share your company name and address to third-party professional advisers including external auditors and consulting company for improve your using experience.
    • Regulators and governmental authorities. In certain circumstances, we need to report some of your personal information to regulators and governmental authorities in order to fulfill lawful obligations. We will share the personal information only when it is required by laws and regulations to the necessary extent.

    1. Introduction

    Pursuant to the Law No. 91/2025/QH15 on Personal Data Protection issued by the National Assembly of Vietnam on 26 June 2025 and its implementing regulations as each may be amended, supplemented or replaced from time to time ("Personal Data Protection Law")., Ocean Network Express (Vietnam) Co., Ltd. (hereinafter "we" or "ONEVN") issues this privacy and personal data protection policy ("Policy") to inform you of the methods of collecting, using, sharing, and protecting personal data obtained in relation to the services we provide and how we comply with the regulation in the whole process of collecting, handling, assessing, filing and protecting your personal data in our current business operations.

    This Policy shall also include terms, conditions, notices regarding personal data processing, and general regulations on personal data processing.

    This Policy applies to the processing of personal data of individual(s) who directly or indirectly uses ONEVN's services in Vietnam (hereinafter referred to as "User" or "Users").

    By using our services, the User acknowledges that the User has read and fully understood this Policy.

    2. Data Processing Responsibility

    ONEVN acts as the Personal Data Controller and/or the Personal Data Controller and Processor (depending on the specific service context) and is responsible for ensuring that the User’s personal data is processed in compliance with Vietnamese laws, specifically the Personal Data Protection Law.

    3. Personal Data Collected by ONEVN

    The type of personal data that ONEVN collects depends on the nature of our relationship with the User and the services provided. This data may include:

    • 3.1. Basic Personal Data of the User:
      • Contact Information: Name, address, email, phone number.
      • Personal Identity Information: Gender, date of birth, nationality, Passport number.
      • Employment Information: Job title, company name of employment.
    • 3.2. Sensitive Personal Data:
      • Financial Information: Bank account number, credit card number, tax code (if applicable), ...
      • Personal Identity Information: Identity Card/Citizen Identification Card.
      • Other sensitive data as prescribed under the Personal Data Protection Law (e.g., location data, biometric data if applicable).

    4. Purposes of Personal Data Processing

    ONEVN only collects and processes the User’s personal data for lawful purposes upon obtaining the User’s consent for personal data processing, including but not limited to:

    • 4.1. Service Provision: To provide services requested by the User or services arranged for the User's benefit (e.g., arranged by the User's employer or ONEVN's partners).
    • 4.2. Business Operations: To manage the relationship with the User, including customer support, payment, and contract performance.
    • 4.3. Legal Compliance: To comply with legal obligations such as tax reporting, accounting audits, "Know Your Customer" (KYC) checks, and anti-money laundering regulations, and to conduct audit and investigations, and to use for litigation, dispute resolution and regulatory proceeding.
    • 4.4. Service Improvement: To analyze market trends and improve internal business processes (using aggregated and anonymized data where possible).
    • 4.5. Marketing: To inform the User about products or services that may interest the User (based on the User's consent and right to opt-out).

    5. Cases of Personal Data Processing Without User's Consent

    • The receipt, sharing, and transfer of personal data as prescribed by law and/or to serve the requirements and activities of state agencies as regulated by the laws of specific sectors.
    • The processing and sharing of User’s personal data with competent state agencies in cases of emergency regarding national defense, national security, social order and safety, major disasters, epidemics, or when there is a risk threatening national defense and security but not to the extent of declaring a state of emergency; prevention and combat of riots, economic crimes, and/or violations of the law as prescribed by law.

    6. How We Collect Data

    • Directly from the User: When the User fills out forms, signs contracts, works with, or communicates with us.
    • Indirectly: From the User's employer, ONEVN's partners, or third parties (e.g., insurance companies, service providers) hiring ONEVN to provide services beneficial to the User.
    • Public Sources: From databases or public registries permitted by law.

    7. Data Sharing With Third Parties

    ONEVN does not share the User's personal data in any situation unrelated to the relevant purpose and function. We only use and share data when necessary for the purposes stated in Section 4, with:

    • Service Providers: Partners supporting us in providing services (e.g., IT support service provider, cloud service providers, auditors, lawyers, consultants).
    • Business Partners: Banking companies or financial institutions required to perform contracts.
    • Competent State Agencies: Regulators, police, courts, or other government agencies when required by law.

    Ocean Network Express Pte. Ltd. and its affiliates: Ocean Network Express Pte. Ltd. to which ONE VN is working as an agent to conduct any business activities and together with its affiliates to provide inter-company support. Affiliates shall include any company controlled by, controlling, or under common control with the Ocean Network Express Pte. Ltd.

    8. Transferring Data Abroad

    If ONEVN needs to transfer the User's data out of the territory of Vietnam (e.g., to cloud servers or international partners), we ensure that such transfer complies with Vietnamese regulations on cross-border data transfer, ensuring the User's data receives an equivalent level of protection.

    9. Data Storage and Security

    • Storage: We only store the User's personal data for the time necessary to fulfill the collection purposes, or as required by law. (e.g., accounting laws require 10- year retention).
    • Security: ONEVN applies strict technical and organizational measures (including encryption, access control, and cybersecurity protocols) to protect the User's personal data against unauthorized access, loss, or misuse. However, security related risks will always exist, and no technical system or security measure is absolutely safe or capable of resisting all "hackers" (those who intrude illegally to exploit information) therefore, in the event that the User's personal information is hacked beyond ONEVN's control, the User agrees to exempt ONEVN from all related liability. ONEVN will coordinate with functional authorities to investigate and handle violations according to legal regulations.
    • To the extent permitted by applicable law, the User agrees to indemnify ONEVN against all legal proceedings involving third parties arising from or related to claims regarding the User's violation, including all legal liabilities and/or costs arising from claims, losses, or damages.
    • It is noted that the main purpose for collection and processing of personal data of User by ONEVN is to provide relevant services to User. As a result, when the User exercises its rights (as prescribed in Article 10 of this Policy), the User would need to consider the consequences of this action.
    • The User's execution of one or simultaneous actions of withdrawing consent, requesting restriction, objecting to personal data processing, and/or deleting personal data may lead to one or simultaneous consequences that ONEVN will have to bear, including but not limited to:
      • (i) Violation of Personal Data Protection Law if User rights are implemented.
      • (ii) Incurring economic damages arising from legal violations.

    In this case, ONEVN is allowed to assess the feasibility and potential implications related to legal consequences or damages as mentioned above, after which ONEVN has the right to consider and decide to unilaterally terminate the fulfillment of the User's requests.

    10. User's Rights and Obligations

    According to the Personal Data Protection Law, the User has the following rights regarding their personal data:

    • Right to be informed: To be informed about how the User's personal data is processed.
    • Right to consent: To agree or disagree to allow the processing of their personal data.
    • Right to access: To view, correct, or request a copy of the User's personal data.
    • Right to withdraw consent: To withdraw permission for us to process their personal data (unless restricted by law or contract).
    • Right to request deleting personal data: To request the deletion of the User's personal data (unless the law requires retention).
    • Right to restrict/object: To restrict or object to personal data processing.
    • Right to complain: To complain or initiate lawsuits according to legal regulations.
    • Right to claim damages: To claim compensation when there is a violation of regulations on the protection of the User's personal data.
    • Right to self-protection: To self-protect or request competent agencies and organizations to implement methods to protect civil rights.

    The User shall have certain obligations under Personal Data Protection Law, such as the obligation to provide complete and accurate Personal Data when consenting to ONEVN’s collection and processing of Personal Data, the obligation to protect their own Personal Data, the obligation to respect and protect others’ Personal Data, and the obligation to comply with the Personal Data Protection Law and prevent violations of personal data protection regulations.

    11. General Terms

    ONEVN reserves the right to amend or supplement any or all content of this Policy subject to the latest update of Personal Data Protection Law as deemed necessary by publicly posting the amended or supplemented Policy content on the website and/or other official channels of ONEVN (at ONEVN's discretion from time to time).

    We encourage the User to regularly review and check the amended or supplemented contents of this Policy. In certain cases, we may also proactively notify Users of significant changes to this Policy, where required by law, so that Users can fully exercise their rights under applicable laws and this Policy.

    If the User does not agree with any amended or supplemented content of this Policy, the User is able to contact us for more discussion or clarification to come to the common conclusion.

    The User agrees to exempt ONEVN from all liability in the event that they do not see any impact on the updated or revised version.

    The User's continued use of the service and continued exchange of information with ONEVN on ONEVN's official channels after this content or subsequent amendments are posted means that the User acknowledges and agrees to ONEVN utilizing personal data under the terms mentioned in this Policy, and ONEVN will process data in accordance with the law.

(en adelante, “ONE”) se encuentra comprometida con la Protección de los Datos Personales de sus clientes, colaboradores, proveedores y de todos quienes hagan uso del sitio web (a través del dominio https://la.one-line.com/es), por lo que aplicará sus mayores esfuerzos y diligencia en su tratamiento, conforme a la política que se explicita detalladamente en el presente documento.

    Primero. MARCO LEGAL

    La presente Política de Privacidad se ajusta a lo dispuesto en la Ley N° 18.331 de 11 de agosto de 2008 y el Decreto N° 414/009 de 21 de agosto de 2009 sobre Protección de Datos Personales y Habeas Data y demás normas complementarias, modificativas y concordantes.

    Tercero. RESPONSABLE DEL TRATAMIENTO

    Con una gestión altamente informatizada, ONE estudia la evolución de las tecnologías y la normativa en materia de Seguridad de la Información y Protección de Datos Personales, tendiente a asegurar la disponibilidad de la información relacionada con los servicios prestados y la protección en todo momento de los derechos de los titulares de los datos.

    ONE es el responsable del tratamiento de los datos personales que obtiene en el desarrollo de sus actividades de sus clientes y de los datos de los usuarios en general, que recaba cuando utilizan su sitio web, y de conformidad con lo previsto en la Ley 18.331 y su Decreto Reglamentario, No 414/009.

    Cuarto. TIPO DE DATOS RECOLECTADOS

    La presente política de privacidad aplica a los datos personales de personas físicas o jurídicas, determinadas o determinables, dentro del territorio uruguayo que ONE recopila a través de su página web https://www.one-line.com/es/local-information/uy - https://www.one-line.com/en/local-information/uy, (en adelante, “Datos Personales”).

    Datos personales se refiere a cualquier información que pueda identificarlo directamente (por ejemplo, su nombre completo) o indirectamente (por ejemplo, su número de teléfono, dirección postal/correo electrónico, datos seudonimizados como un identificador único, entre otros).

    Los Datos Personales recolectados serán incorporados a la base de datos de OCEAN NETWORK EXPRESS (URUGUAY) S.A., RUT 217990520010, con domicilio a estos efectos en Av. Dr. Luis Alberto de Herrera 1248, World Trade Center, Torre III, Piso 16, Oficina 1676, y contará con las medidas de seguridad adecuadas tendientes a considerar su integridad, disponibilidad y confidencialidad.

    Quinto. FINALIDAD Y LEGITIMACIÓN DEL TRATAMIENTO

    ONE recopila y procesa datos personales que son relevantes, adecuados, no excesivos y estrictamente necesarios para los fines perseguidos.

    El tratamiento de los datos personales de los clientes ONE tiene como finalidad asegurar el adecuado cumplimiento de la relación contractual, cumplir con las obligaciones legales y brindar servicios e información sobre productos y promociones según corresponda.

    El tratamiento de los datos personales de los usuarios que se recaban cuando utilizan los medios digitales puestos a disposición por ONE, tiene como finalidad generar registros del número y frecuencia de visitas y de la actividad de los usuarios, personalizar campañas en redes sociales y, realizar el análisis y seguimiento de los resultados de estas acciones. Todo ello con el objetivo de brindar un mejor servicio y facilitar el uso de los medios digitales. A tales efectos, ONE utiliza cookies y tecnologías similares (en adelante, “cookies”) que el usuario puede aceptar o rechazar a través de la configuración de su navegador. Consulte aquí nuestra Política de Cookies.

    La recolección y tratamiento de los datos obtenidos mediante los mecanismos automatizados mencionados no implica asociar dicha información a usuarios identificados o identificables. ONE no utilizará la información obtenida de redes o proveedores de servicios de análisis para fines distintos a los informados en esta política.

    El tratamiento de los datos personales proporcionados por el usuario en formularios y/o contratos digitales y/o cualquier otro tipo de documento o registro de cualquier naturaleza, tiene como finalidad brindar servicios de transporte marítimo internacional, gestión de carga, logística y atención comercial para importadores y exportadores que el cliente solicite para cumplir actividades necesarias para la ejecución de la relación contractual, así como obtener datos estadísticos en relación a los servicios prestados.

    La base de legitimación del tratamiento de los datos para esta finalidad de comunicación es el consentimiento informado del usuario, que se recabará en la oportunidad de recolectar los datos. El usuario podrá retirar el consentimiento para esta finalidad en cualquier momento a través de los medios que se informan en esta política, sin que ello implique condicionamiento alguno al acceso a los servicios que brinda o comercializa OCEAN NETWORK EXPRESS (URUGUAY) S.A., ni al uso de las herramientas que disponibiliza a los usuarios en general.

    Sexto. COMUNICACIÓN A TERCEROS Y TRANSFERENCIA INTERNACIONAL DE DATOS

    ONE no realizará ninguna cesión ni comunicación a terceros de los datos personales recolectados salvo las excepciones legales previstas en la ley No.18.331 de Protección de Datos Personales y Acción de Habeas Data y demás normas complementarias, modificativas y concordantes o, cuando la consecución de la finalidad perseguida por el usuario así lo requiera, o con su consentimiento.

    Séptimo. TRANSFERENCIA INTERNACIONAL DE DATOS

    ONE es una empresa global y, en consecuencia, podrá transferir los Datos Personales a servidores ubicados fuera de Uruguay, como ser proveedores de servicios que traten los Datos Personales, incluso si dichos proveedores se encuentran en países que no cuentan con niveles de protección similares a los de Uruguay, aunque siempre bajo medidas de seguridad y confidencialidad, siendo la base legal para la transferencia el consentimiento a las presentes Políticas, durante el plazo que dure la prestación de los servicios a ONE Uruguay. Por ejemplo, con el fin de personalizar campañas en redes sociales, ajustándose a los intereses de los usuarios, se utilizan herramientas como Instagram Ads y LinkedIn, creando una audiencia a partir de los datos recolectados (entre otros, direcciones de correo electrónico y números de teléfono) los cuales son compartidos con Meta Platforms Inc. para crear públicos personalizados y dirigir los anuncios que ONE considera que pueden ser de interés para el usuario. Este proveedor tiene sus servidores en Menlo Park, California, y opera bajo sus propios términos de servicios, los que incluyen medidas de seguridad por ser una organización ubicada en los Estados Unidos adherida al “EU-US Data Privacy Framework”.

    Asimismo, ONE podrá transferir Datos Personales a sus empresas vinculadas independientemente del país en el cual se encuentren, incluso a aquellos países que no cuenten con niveles de protección adecuados conforme a la Resolución No. 70/2023 de la URCDP, tales como Brasil y Singapur, entre otros con la finalidad de prestar servicios a ONE Uruguay y estadística, entre otras, durante el plazo que dure la prestación de los servicios a ONE, siendo en esos casos la base legal el Código de Conducta de ONE. En todo momento, el usuario puede configurar sus preferencias conforme se detalla en nuestras Política de Cookies.

    El consentimiento para la transferencia internacional de datos se recabará en el momento de recoger los datos, ya sea por medio de un formulario, contrato u otro documento o registro correspondiente, con la disponibilidad previa de la información adecuada para el usuario. En cualquier momento, el usuario podrá retirar su consentimiento, siendo las únicas consecuencias de esta acción: i) dejar de visualizar los anuncios personalizados en redes sociales y; ii) dejar de recibir las comunicaciones de ONE vía correo electrónico.

    La finalidad de las transferencias internacionales será la de prestar servicios a ONE y se realizará durante el plazo que duren dichos servicios, siendo la base de legitimación el consentimiento del titular, la declaración de Privacy Framework, el Código de Conducta o las bases de legitimación que sean aplicables en cada caso.

    Octavo. USO DE APLICACIONES DE MENSAJERÍA INSTANTÁNEA

    ONE podrá ofrecer canales de comunicación con los usuarios a través de aplicaciones de mensajería instantánea como WhatsApp y Telegram, con la finalidad de agilizar la gestión de sus solicitudes, realizar un más efectivo seguimiento o enviar información comercial, sobre lanzamientos o productos y, en general, de establecer un canal de comunicación para recibir y enviar mensajes vinculados a la actividad de ONE.

    Los datos necesarios para el uso de estos canales sólo estarán en el citado grupo de WhatsApp/Telegram administrado por ONE, con el número de móvil que se indique como responsable del tratamiento, quien ha adoptado las medidas técnicas y organizativas necesarias para garantizar un nivel de seguridad adecuado para los datos personales.

    Sin perjuicio de lo expuesto, el usuario debe valorar que las empresas proveedoras de estas aplicaciones de mensajería instantánea operan bajo sus propios términos de servicios y, utilizan servidores instalados en el exterior del país, incluso en territorios considerados no adecuados por Uruguay para transferencias internacionales de datos como Estados Unidos de América, por lo cual, es recomendable que lea detenidamente sus condiciones de uso y políticas de privacidad, así como que configure sus preferencias, en cuanto al tratamiento de los datos, lo cual podrá realizar desde las propias aplicaciones.

    El uso de estas aplicaciones de mensajería instantánea con ONE, será completamente optativo para el usuario, ya que ONE siempre permitirá la utilización de canales de comunicación alternativos.

    Debidamente informado de estos extremos, al utilizar el usuario estas aplicaciones de mensajería instantánea con ONE, está manifestando conocer y aceptar los términos de esta cláusula, y consentir inequívocamente su uso, incluyendo el consentimiento a la transferencia internacional de datos, que, en su caso, pueda estar implicada.

    Noveno. MEDIDAS DE SEGURIDAD

    ONE ha adoptado las medidas técnicas y organizativas necesarias tendientes a garantizar la integridad, disponibilidad y confidencialidad de los datos personales que se encuentran en sus bases.

    Décimo. DERECHOS DE LOS TITULARES DE LOS DATOS

    Los titulares de los Datos Personales, previa acreditación de su identidad podrá ejercer los derechos de acceso, rectificación, actualización, inclusión y supresión de sus Datos Personales, con arreglo a lo previsto en la Ley No 18.331, sus reglamentaciones, modificativas y concordantes ante OCEAN NETWORK EXPRESS (URUGUAY) S.A., y conforme a lo dispuesto en el artículo 15 de la mencionada Ley de Protección de Datos.

    Para ejercer estos derechos, el titular deberá enviar un correo electrónico a [email protected] con su solicitud, adjuntando su nombre completo, número de documento de identidad (incluyendo una copia del mismo), y detallando la solicitud y las razones que fundamentan el ejercicio de su derecho. En caso de ser solicitado, también deberá proporcionar la documentación adicional que ONE considere razonable para procesar su solicitud. Alternativamente, podrá dirigirse personalmente al domicilio de ONE en Av. Dr. Luis Alberto de Herrera 1248, World Trade Center, Torre III, Piso 16, Office 1676, CP 11300, departamento de Montevideo, República Oriental del Uruguay.

    Para facilitar el ejercicio del derecho de supresión de los datos vinculados a la finalidad de email marketing, en todas las comunicaciones se incluye una indicación de cómo proceder para la baja, cuyo uso redundará en la eliminación inmediata de los datos personales del usuario de la base de datos para dicha finalidad.

    Décimo Primero. ENLACES DE TERCEROS Y REDES SOCIALES

    La presente Política de Privacidad es de aplicación exclusiva a los datos en posesión de ONE recopilados por los medios anteriormente mencionados.

    El sitio web de ONE puede contener enlaces a otros sitios que pueden ser de interés del Usuario. Una vez éste acceda por medio de los enlaces del sitio web o de un enlace externo y abandone la web de ONE, ONE dejará de tener control sobre el sitio al que se redirige, y por lo tanto no es responsable de los términos, de la privacidad ni de la protección de Datos Personales de esos otros sitios. Dichos sitios están sujetos a sus propias políticas de privacidad, las cuales es recomendable consultar previo a su utilización.

    El usuario tiene la opción de unirse a las páginas o grupos que ONE S.A. tenga en distintas redes sociales, sin embargo, los datos pertenecerán a la Red Social correspondiente, por lo que ONE no es responsable del tratamiento de cualquier dato personal que el usuario revele a través estas páginas de redes sociales, siendo recomendable que el usuario lea detenidamente sus condiciones de uso y políticas de privacidad, así como que configure sus preferencias en cuanto al tratamiento de los datos.

    Décimo Segundo. PLAZO DE CONSERVACIÓN

    Los datos se conservarán mientras sean necesarios para las finalidades para las que fueron recolectados en cada caso o, hasta que el usuario solicite su supresión. Cuando correspondiere, los datos se conservarán durante el tiempo necesario para atender a cuestiones legales por el término de prescripción aplicable.

    Décimo Tercero. ACTUALIZACIÓN DE LA POLÍTICA DE PRIVACIDAD

    ONE se reserva el derecho de revisar, modificar y actualizar permanentemente todos los aspectos relativos a su Política de Privacidad en cualquier momento, sin previo aviso, a los efectos de reflejar cambios introducidos en las prácticas de la empresa en materia de datos personales en cumplimiento de la legislación vigente o para reflejar cambios en políticas propias. En el momento que la misma sea actualizada, será informado al titular de los datos a través del sitio web ONE, según corresponda.

    Cuando se introduzcan cambios sustanciales, ONE podrá notificar a los titulares de los datos, sin perjuicio de informar en las Políticas la fecha de la última actualización. Sin embargo, es responsabilidad de los titulares revisar la política con cierta frecuencia para asegurarse de estar al tanto y de acuerdo con los cambios realizados. En caso de no estar de acuerdo, se deberán abstener de utilizar el sitio web de ONE.
